2-2 YEAR ENERGYSTAR STANDARD LIMITED WARRANTY STARTING January 01, 2024
This Limited Warranty is subject to the Dandelion Energy Standard Terms and Conditions of Sale applicable at time of original equipment shipment from Dandelion Energy, a current copy of which is made available at dandelionenergy.com/terms-conditions.
Dandelion Energy warrants all internal components of the geothermal heat pump to be free from defects in material and workmanship under normal use and maintenance for a period of TWO (2) years from the Warranty Commencement Date (as defined below). Dandelion Energy warrants the major refrigeration components, defined as the air coil, compressor and water to refrigerant heat exchanger, to be free from defects in material and workmanship under normal use and maintenance for a period of FIVE (5) years from the Warranty Commencement Date.
Dandelion Energy warrants all internal components of the geothermal heat pump with service labor allowances related to servicing, removing or reinstalling parts for any defect in materials and workmanship as set forth above for a period of TWO (2) years from the Warranty Commencement Date when purchased with a Dandelion GEO geothermal heat pump. Labor allowances are intended to assist in the offset of contractor’s repair costs and may not cover the full amount of labor charged by the servicing contractor.
The Warranty Commencement Date is equal to the geothermal heat pump’s date of shipment from Dandelion Energy if the system has not been registered. For systems that have been registered with Dandelion Energy, the Warranty Commencement Date will be equal to the geothermal heat pump’s installation date or TWELVE (12) months from the geothermal heat pump’s date of shipment from Dandelion Energy, whichever comes first.
CONDITIONS AND EXCLUSIONS:
The Limited Warranty only applies if the following conditions are met:
- This Limited Warranty will not apply and shall be null and void if the Dandelion Energy serial number has been altered, defaced or removed.
- This Limited Warranty shall be null and void if the Dandelion Energy unit has been disconnected or removed from the location of original installation, or if dealer-seller has not been paid in full for the unit.
- This Limited Warranty shall not apply to unit failure or defect caused by improper installation, field modification, improper electric power delivery from local electric company or other battery, powered generator or stand-by devices, improper maintenance or misuse including operation during building construction, corrosion caused by airborne contaminants, chlorine or salt air exposure, corrosive liquids or water (see installation manuals for water quality guidelines), abuse, neglect, Act of God, outdoor installation, damage from abuse, accident, fire, flood and the like, or to defects or damage caused by the use of any attachment, accessory or component not authorized by Dandelion Energy.
- This Limited Warranty shall not apply and shall be null and void if the Dandelion Energy unit has been installed as part of an open loop (well water) system. To ensure that the water-to-refrigerant heat exchanger will not be subjected to adverse conditions, the Dandelion GEO shall not be installed as part of an open loop system. This Limited Warranty shall not apply to any unit installed with an open loop.
- Closed loop systems — frozen heat exchangers: To ensure that the water-to-refrigerant heat exchanger will not be subjected to freezing conditions, which could cause the heat exchanger to rupture, all units require antifreeze in the source (ground loop) fluid if the temperature will drop below 40 degrees Fahrenheit or there will be any piping exposed to freezing/outdoor conditions. Antifreeze concentration must provide a minimum freeze protection of 10 to 15 degrees Fahrenheit below the minimum expected entering water temperature. If antifreeze is not included as outlined above, the application will be considered an improper installation as outlined in item “C”, and therefore the refrigerant circuit will be excluded from the limited warranty.
- Closed loop systems — water quality: To ensure that the heat exchanger will not be subjected to adverse conditions, treatment with the appropriate concentration of Fernox F1 Inhibitor or an Dandelion approved equal (Fernox Alphi 11 propylene glycol antifreeze when used in concentration of 25% or greater also provides sufficient inhibitor) is required for all geothermal heat pump units. Any warranty claim related to a water circuit component (water-to-refrigerant heat exchanger failure/water in the refrigerant circuit, pump/flow center failure, or any other water circuit component) requires a water sample to be submitted to Dandelion Energy for evaluation. In the event the sample fails to meet published guidelines at the time of unit shipment, the application will be considered an improper installation as outlined in item “C”, relating to water quality, and therefore the refrigerant circuit will be excluded from the limited warranty.
- Replacement or repaired parts and components are warranted only for the remainder of the original warranty period, as stated above
- This Limited Warranty applies only to Dandelion Energy residential single-family, owner-occupied use units sold and installed by a trained, independent, contractor-customer of Dandelion Energy, or an authorized representative and/or distributor, in the United States or Canada, and subjected to normal usage as described and rated on the applicable descriptive sheet for such unit. This warranty shall not be valid if equipment is not installed in accordance with methods prescribed in our data and technical manuals and in compliance with local codes. Improper installation may endanger the occupants of the dwelling. Contractor or customer must complete the on-line warranty registration available at dandelion-pro.com/warranty within ninety (90) days after unit installation or TWELVE (12) months from Dandelion Energy’s ship date, whichever is earlier.
- The obligation for Dandelion Energy under this Limited Warranty is expressly limited to replacement of any parts or components as specified and found within the cabinet. Dandelion Energy reserves the right to replace defective components under warranty with new or reconditioned parts.
- Dandelion Energy does not warrant equipment which has been custom built or modified to purchaser-user specifications. Likewise, any field modification of any equipment shall also void this, and any and all warranties.
- Regular maintenance such as filter changes, drain pan and/or p-trap cleaning, loop flushing/pressurization, and other monthly/annual maintenance is not covered.
- Dandelion Energy is responsible for the cost of shipping warranty replacement parts to the distributor of the parts. Purchaser-user is responsible for any shipping cost of returning the failed part to the dealer or distributor.
- Outdoor installation of any equipment shall cause this and all warranties to be deemed void.
- Labor allowances are provided in the Service Labor Allowance Schedule for Dandelion Energy Residential Heat Pumps applicable at time of original equipment shipment from Dandelion Energy, a current copy of which is made available at dandelion-pro.com/labor-allowance-schedule.
- Items not specified in the coverage above will carry their manufacturer’s stated warranty coverage.
THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES (AND IMPLIED CONDITIONS IN CANADA), WHETHER ORAL OR WRITTEN, EXPRESSED, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ALL SUCH WARRANTIES, EXPRESSED, IMPLIED OR STATUTORY, ARE EXCLUDED AND SHALL NOT APPLY TO THE GOODS OR ANY SERVICES. THIS LIMITED WARRANTY STATES THE SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH OF WARRANTY. TO THE MAXIMUM EXTENT LEGALLY PERMITTED, WHETHER OR NOT COMPANY WAS AWARE OR ADVISED OF THE POSSIBILITY OF DAMAGES, AND WHETHER OR NOT THE LIMITED REMEDIES PROVIDED HEREIN FAIL OF THEIR ESSENTIAL PURPOSE: (A) COMPANY’S AGGREGATE LIABILITY (WHETHER BASED ON WARRANTY, CONTRACT, TORT, INCLUDING NEGLIGENCE, OR ANY OTHER LEGAL THEORY) WILL IN NO CIRCUMSTANCES EXCEED THE AGGREGATE AMOUNT OF PAYMENTS MADE FOR GOODS AND SERVICES ORDERED BY YOU UNDER THESE TERMS DURING THE SIX (6) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY; AND (B) IN NO EVENT WILL COMPANY BE LIABLE FOR SPECIAL, EXEMPLARY, INCIDENTAL, PUNITIVE, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE, OR COST OF COVER (WHETHER BASED ON WARRANTY, CONTRACT, TORT, INCLUDING NEGLIGENCE, OR ANY OTHER LEGAL THEORY). SOME STATES, COUNTRIES AND PROVINCES DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
